This document contains two sets of terms:
PART A: Website Terms - Governs your use of our website
PART
B: Booking & Holiday Conditions - Governs your stay at Bubble on the Beach
Both apply to you when you make a booking through our website. Please read both sections carefully.
Website Terms & Conditions (Part A)
1. Introduction
Welcome to the Bubble on the Beach website. These terms govern your use of our website (www.bubbleonthebeach.com). By using our website, you agree to these terms. If you do not agree, please do not use our website.
2. Use of This Website
2.1 Access
The content on this website is for your general information and use only. It is subject to change without notice.
2.2 Account Registration
Certain areas may require registration. By registering, you agree to:
- Provide accurate and complete information
- Update information to maintain accuracy
- Maintain confidentiality of your account details and password
2.3 Acceptable Use
You agree to use our website only for lawful purposes. Prohibited behaviour includes:
- Harassing or causing distress to others
- Transmitting obscene or offensive content
- Disrupting normal website functionality
- Infringing others' rights or restricting their use of the website
3. Intellectual Property
3.1 Copyright
All website content (text, graphics, logos, images, audio, software) is the property of Bubble on the Beach or its content suppliers, protected by international copyright laws.
3.2 Permitted Use
You may view, download, and print content for personal, non-commercial use only, provided you:
- Do not modify documents or graphics
- Do not remove copyright or proprietary notices
- Do not use material on other websites or publicly accessible platforms
3.3 Trademarks
All trademarks reproduced on this website are acknowledged as property of their respective owners.
4. User Content & Reviews
4.1 License Grant
By submitting content (reviews, comments, photos), you grant Bubble on the Beach a worldwide, royalty-free, perpetual, non-exclusive licence to use, reproduce, modify, publish, and display such content.
4.2 Content Standards
Submitted content must not:
- Be defamatory, obscene, offensive, or inflammatory
- Promote explicit material, violence, or discrimination
- Infringe copyright or trademarks
- Be deceptive or made in breach of legal duty
- Impersonate others or misrepresent your identity
- Harass, threaten, or cause anxiety to others
5. Third-Party Links & Booking Platforms
5.1 Links to Other Websites
Our website may contain links to third-party sites for your convenience. We accept no responsibility for their content or any loss arising from their use.
5.2 Third-Party Booking Platforms
Bookings made through third-party platforms (Booking.com, Airbnb, travel agencies) are subject to:
- Those platforms' terms and conditions
- Those platforms' privacy policies
- Our booking conditions (Part B below)
Important: Regardless of booking method, Moroccan legal requirements for guest identification apply to all bookings (see Part B, Section 2.5).
5.3 Linking to Our Website
You may link to our homepage if done fairly and legally, without damaging our reputation. You must not suggest association or endorsement where none exists.
6. Disclaimers & Limitations
6.1 Accuracy of Information
While we endeavour to ensure website information is correct, we do not warrant completeness or accuracy, nor commit to keeping the website continuously available or up to date.
6.2 Property Representations
Photos and descriptions aim for accuracy. However, variations may occur due to the handcrafted, natural character of our property and ongoing improvements.
6.3 Warranty Disclaimer
To the maximum extent permitted by law, we provide this website "as is" with no representations or warranties.
6.4 Limitation of Liability
We are not liable for direct, indirect, special, or consequential damages arising from your use of, or inability to use, this website.
7. General Website Provisions
7.1 Indemnity
You agree to indemnify and hold harmless Bubble on the Beach from all losses, expenses, and costs resulting from your violation of these terms.
7.2 Changes to Terms
We may revise these terms at any time. Please check regularly, as continued use constitutes acceptance of changes.
7.3 Severability
If any term is determined illegal or unenforceable, it shall be severed. Remaining terms continue to be binding.
7.4 Governing Law
These website terms shall be governed by and construed in accordance with relevant international laws.
Booking Conditions & Terms of Business (Part B)
1. Making Your Booking
1.1 Authority to Book
When making a booking, the "lead name" guarantees they have authority to accept these conditions on behalf of all party members. For party members under 18, the lead name must have parental or legal guardian authority.
1.2 Booking Confirmation
A booking is confirmed when we receive your 50% deposit. We will issue a booking confirmation, at which point a contract forms between us. We reserve the right to refuse any booking before issuing confirmation. If refused, we will promptly refund any payment.
2. Payment Terms
2.1 Deposit
To confirm your accommodation, you must pay a 50% deposit of the total reservation cost.
2.2 Balance Payment
The balance is due upon arrival at Bubble on the Beach. Payment can be made by card (directly or via PayPal) or cash.
2.3 Extras & Additional Services
Any extras (additional meals, treatments, activities, boutique purchases) should be settled at the end of your stay.
2.4 Moroccan Tourist Tax
A Moroccan tourist tax of approximately €2.50 per person per day will be added to your final bill.
2.5 Moroccan Legal Requirements
Important Notice: Moroccan law requires all accommodations to report guest identification details to local authorities. By making a booking, you acknowledge and consent to our collection and sharing of personal information (full name, nationality, passport/ID details, dates of stay) with Moroccan governmental authorities. This is mandatory for all guests regardless of nationality or booking method.
3. Prices & Accuracy
3.1 Rate Changes
Prices shown may change before booking. We reserve the right to raise or lower prices at any time, though changes will not affect confirmed bookings.
3.2 Errors
We make every effort to ensure accuracy, but errors occasionally occur. We reserve the right to correct errors in advertised and confirmed prices. Please verify all details at time of booking.
4. Cancellations & Refunds
4.1 Standard Cancellation Policy
If you cancel after booking confirmation:
- More than 30 days before arrival: Full refund less €50 administration fee
- 15-30 days before arrival: 50% refund
- Less than 15 days before arrival: No refund
4.2 No Refund for Early Departure
If you leave before your booked departure date, no refund will be made for unused accommodation or services.
4.3 Partial Party Cancellations
If only some party members cancel:
- Applicable cancellation charges apply to cancelled guests
- Holiday cost will be recalculated for remaining guests
- You may incur additional charges (single room supplements, etc.)
4.4 Non-Refundable Arrangements
Certain arrangements (specific activities, special bookings) may not be cancelled after confirmation and could incur 100% cancellation charge.
5. Arrival & Departure
5.1 Check-In
Standard check-in is between 15:00 and 20:00 on your arrival date. Other times can only be considered in exceptional circumstances.
Important: If delayed, you must contact us to arrange alternatives. Failure to arrive by 20:00 without notice will be treated as cancellation by you.
5.2 Check-Out
Guests must vacate rooms by 11:00 on departure date. This may be flexible depending on incoming guests.
6. Guest Responsibilities & Behaviour
6.1 Conduct
By booking, you accept responsibility for proper conduct of yourself and your party whilst on holiday.
6.2 Property Regulations
You agree to:
- Comply with property regulations and reasonable rules made from time to time
- Keep and leave the property, furnishings, bedding, and towels clean and in good condition
- Not cause damage to the property
- Not cause nuisance or annoyance to us or other guests
6.3 Smoking Policy
No smoking is permitted in rooms, galleries, swimming pool area, or central studio.
6.4 Insurance Requirements
You agree to ensure each party member has:
- Comprehensive travel insurance (cancellation, delays, baggage loss)
- Health insurance (including evacuation and repatriation coverage)
- Relevant sports insurance if participating in activities
6.5 Unauthorised Guests
Unauthorised guests may not enter the property or stay in your rooms. Breach of this rule may result in immediate termination without refund.
6.6 Local Laws & Customs
You agree to adhere to Moroccan laws and respect local customs whilst at the property.
6.7 Property Access
You agree to allow us or our representatives reasonable access to your room for cleaning and essential repairs.
6.8 Termination for Misconduct
If you or your party behaves in a way that causes or is likely to cause danger, upset to others, or property damage, we may terminate your holiday. The person(s) concerned must leave immediately with:
- No further responsibility from us (including return travel)
- No refunds
- No payment of expenses or costs incurred
You are responsible for full payment of any damage or loss caused. Payment must be made directly and immediately. Failure to pay will result in you being liable for our full legal costs.
7. Events Beyond Our Control (Force Majeure)
7.1 No Reimbursement
No reimbursements are made for late arrivals or early departures, regardless of reason.
7.2 Force Majeure Events
We are not responsible for events beyond our control, including but not limited to:
- Accident or illness
- War, threat of war, riot, civil strife, terrorist activity
- Government action, political unrest
- Natural disasters (fire, flood, drought, earthquake)
- Weather conditions
- Industrial disputes
- Airport closures, flight cancellations/rescheduling
- Technical problems with transportation
- Nuclear incidents
The lead name assumes all risks associated with the holiday and indemnifies our directors and hosts against all claims arising from participation.
8. Liability
8.1 Our Responsibility
We accept responsibility for arranging your holiday with reasonable skill and attention. Services will be deemed provided with reasonable skill and care if they:
- Comply with local regulations, OR
- Are reasonable compared to local standards (if no regulations apply)
8.2 Limitation of Liability
We will not be responsible for:
- Additional expenses, distress, disappointment, loss, damage, injury, accident, delay, or inconvenience
- Results from acts or defaults of third-party companies, firms, or persons
Exception: We are responsible if caused by our proven negligence or proven lack of diligence.
8.3 Activity Participation
Participation in activities is at your own risk. You agree to exonerate Bubble on the Beach from liabilities, including injuries, deaths, or damages arising from activities.
8.4 Personal Possessions
We cannot be responsible for personal possessions that are:
- Misplaced, stolen, or damaged during your stay
- Left behind on the premises
9. Weather Conditions
9.1 Activity Cancellations
We cannot be responsible for weather adversely affecting your ability to participate in activities.
9.2 Safety Cancellations
If conditions are hazardous due to weather, we may curtail or cancel activities. We will endeavour to find alternatives.
10. Programme Changes & Cancellations
10.1 Right to Modify
We reserve the right to:
- Make changes to and correct errors in holiday details before and after booking confirmation
- Cancel confirmed bookings if necessary (e.g., minimum numbers not reached)
10.2 Major Changes or Cancellations
Most changes are minor. In rare cases of full cancellation, we will offer:
- An alternative holiday (if available and time permits), OR
- Full refund of monies paid
11. Special Requests & Accessibility
11.1 Special Requests
Special requests must be made at time of booking. Notation on confirmation does not guarantee the request will be met. Failure to meet a special request is not a breach of contract unless specifically confirmed.
11.2 Accessibility & Disabilities
Bubble on the Beach does not have wheelchair ramps, lifts, or other accessibility modifications. Important: You must advise us of any disabilities or special requirements at booking so we can assess whether we can meet your needs.
If we reasonably feel unable to properly accommodate your needs, we will:
- Not confirm the booking, OR
- Cancel if full details weren't provided at booking time
12. Promotional Materials
12.1 Use of Guest Content
We reserve the right to use photographs, artwork, video footage of guests (children or adults) on our website, publications, and advertising materials.
You granted permission for this use when submitting content (see Part A, Section 4).
13. Complaints & Resolution
13.1 During Your Stay
If you have any complaint, please notify us immediately so we can resolve it promptly. Most issues can be addressed during your stay.
13.2 Post-Stay Complaints
If a complaint cannot be resolved during your stay, you must write to us with full details within 14 days of your departure date.

15. Governing Law
These booking conditions shall be governed by and construed in accordance with relevant international laws. Any disputes shall be subject to the exclusive jurisdiction of courts where the case may be heard.
By completing a booking, you confirm that you have read, understood, and agree to both Part A (Website Terms) and Part B (Booking & Holiday Conditions).
